TOWN OF ELIZABETHTOWNResolution Authorizing the Advertisement for Sealed Bids For the Sale of Certain PropertyWHEREAS, the Town Council of the Town of Elizabethtown desires to dispose of certain surplus property of the Town of Elizabethtown;NOW, THEREFORE, BE IT RESOLVED by the Town Council that:1. The following described property is hereby declared to be surplus to the needs of the Town of Elizabethtown:Lying and being in the Town of Elizabethtown, Elizabeth Township, Bladen County, North Carolina, bounded on the north by Lots 136 and 137 as shown on a map entitled, "Elizabethtown, N.C." and recorded in Map Book 2, Page 1 in the Bladen County Register of Deeds Office, bounded on the east by Pine Street, on the South by the old right of way of the Virginia & Carolina Southern Railroad (now N.C.S.R. 1358 - W. Swanzy Street), on the west by S. Slingsby Street, and being the combined area of the following three lots or parcels of land:LOT "A"Beginning at the southeastern corner of Lot 136, as shown on Map Book 2, Page 1, said corner being located at the intersection of the western right of way line of Pine Street and the northern right of way line of an unimproved 50-foot wide right of way labeled as "Swanzy St." on said map;Running thence from the Point of Beginning so located, the following bearings anddistances:1) Along the northern margin of the unimproved 50-foot right of way and the southern boundary of Lot 136, North 68 degrees West – 105 feet, more or less, to the southwestern corner of Lot 136 and the southeastern corner of Lot 137;2) Thence along a new line and crossing the 50’ unimproved right of way of the old Swanzy Street, South 22 degrees West – 70 feet, more or less, to a point in the northern margin of the old right of way of the old Virginia & Carolina Southern Railroad (now N.C.S.R. 1538 - W. Swanzy Street);3) Thence along the northern margin of N.C.S.R. 1538 (W. Swanzy Street), South 68 degrees East – 105 feet, more or less, to a point in the western right of way line of Pine Street;4) Thence with the western margin of Pine Street, North 22 degrees East – 70 feet, more or less, to the Point of Beginning.Containing 7,350 square feet, more or less, inclusive of the unimproved 50-foot wide right of way identified as "Swanzy St." on the aforementioned map. This parcel is subject to any and all valid easements or rights of way of record.LOT "B"Beginning at the southeastern corner of Lot 137, as shown on Map Book 2, Page 1, as recorded in the Bladen County Register of Deeds Office, said corner being located on the northern right of way line of an unimproved 50-foot wide right of way labeled as "Swanzy St." on said map;Running thence from the Point of Beginning so located, the following bearings anddistances:5) Along the northern margin of the unimproved 50-foot right of way and the southern boundary of Lot 137, North 68 degrees West – 72.5 feet, more or less, to a point;6) Thence crossing the 50’ unimproved right of way of the old Swanzy Street, South 22 degrees West – 70 feet, more or less, to a point in the northern margin of the old right of way of the old Virginia & Carolina Southern Railroad(now N.C.S.R. 1538 - W. Containing 5075 square feet, more or less, inclusive of the unimproved 50-foot wide right of way identified as "Swanzy St." on the aforementioned map. Slingsby Street and the northern right of way line of an unimproved 50-foot wide right of way labeled as "Swanzy St." on said map;Running thence from the Point of Beginning so located, the following bearings anddistances:9) Along the northern margin of the unimproved 50-foot right of way and the southern boundary of Lot 137, South 68 degrees East – 72.5 feet, more or less, to a point;10) Thence crossing the 50’ unimproved right of way of the old Swanzy Street, South 22 degrees West – 70 feet, more or less, to a point in the northern margin of the old right of way of the old Virginia & Carolina Southern Railroad(now N.C.S.R. 1538 - W. Swanzy Street);11) Thence along the northern margin of N.C.S.R. 1538 (W. Swanzy Street), North 68 degrees West – 72.5 feet, more or less, to a point in the eastern margin of S. Slingsby Street;12) Thence running along the eastern margin of S. Slingsby Street and crossing the 50’ unimproved right of way of the old Swanzy Street, North 22 degrees East – 70 feet, more or less, to the Point of Beginning.Containing 5075 square feet, more or less, inclusive of the unimproved 50-foot wide right of way identified as "Swanzy St." on the aforementioned map.This parcel is subject to any and all valid easements or rights of way of record.2. The Town Manager is authorized and directed to receive on behalf of Town Council, sealed bids for the purchase of the properties described above with a minimum bid of $5,000 for each of the three lots. 3. Sealed bids may be submitted to the Town Manager’s office to be opened on July 8, 2014 at 4 p.m. at the Elizabethtown Municipal Building, 805 West Broad Street. Envelope must be marked "Sealed Bid for Real Estate".4. The Town Clerk shall cause a notice of this resolution to be published in accordance with G.S. 160A-268.5. Bids will not be accepted unless, upon time of filing, they are accompanied by a deposit of cash, cashier’s or certified check, or bid bond equal to 5% of the amount bid.6.
